Terms of Service

By creating an account, logging in, or using any part of the Service, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If any portion is unacceptable to you, please do not use the Service.

These Terms are paired with our Privacy Policy and any additional policies we publish in the app (for example, the Chat Policies page and community guidelines). Policies referenced here are incorporated by this reference.

To use the Service you must be at least 18 years old and legally capable of entering a binding contract in the jurisdiction where you reside. By registering, you represent that both are true.

You are not eligible to use HonmeiDate if any of the following apply:

• You are currently subject to a court order, injunction, or similar legal restriction that prohibits you from using a dating, social, or communications service.
• You are a registered sex offender in any jurisdiction.
• You have previously been banned from HonmeiDate for violations of these Terms or our community policies, and we have not agreed in writing to reinstate you.
• Applicable law in your country prohibits you from using a service of this type.

The Service is not intended for, and we do not knowingly collect data from, minors. If we learn an account belongs to someone under 18, we will close the account and delete associated personal data.

You will create exactly one account, tied to a real email address that belongs to you. You are responsible for keeping your credentials confidential and for all activity that happens under your account — including activity you didn't personally authorize if it traces to credentials you failed to protect.

Profile information you provide must be truthful. Deliberately false identity, age, or biographical details — including impersonation of another real person — is a breach of these Terms and grounds for immediate termination.

Do not transfer, share, sell, or loan your account. Do not create accounts for other people. Do not use automated tools to create accounts.

Tell us promptly if you believe your account has been accessed without your permission so that we can help you secure it.

HonmeiDate offers a free tier and one or more paid tiers. Current pricing and included features are set out on the Pricing page and may change from time to time with reasonable advance notice to existing subscribers.

Auto-renewal.

Paid subscriptions renew automatically at the end of each billing period for the same duration and at the then-current rate, unless you cancel before the renewal date. Canceling takes effect at the end of the current paid period — you keep access until then.

Payment processing.

Payments are processed by a third-party payment provider. By providing payment information, you authorize that provider — and us, as its customer — to charge the selected amount to your chosen payment method. If a charge is declined, your paid features may be suspended until the issue is resolved.

Refunds.

Except where required by law, subscription fees are non-refundable once a billing period has started. We may grant refunds at our discretion — for example, if a technical failure on our end prevented you from using a paid feature for a meaningful portion of a billing period.

Promotions, credits, and one-off items.

From time to time we may offer free trials, promotional pricing, or consumable items (for example, profile boosts). Any such offer is subject to its own terms published alongside it. Promotional credits have no cash value, cannot be transferred between accounts, and expire as described at the point of grant.

Taxes.

Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes that apply to your purchase and that are not collected by us or the payment provider.

You keep ownership of the photos, messages, profile text, and other material you upload, post, or send through the Service ("Your Content"). Posting it does not transfer any underlying rights to us.

By submitting Your Content, you grant MensuraMedia a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, transmit, display, reproduce, adapt, and create derivative works of Your Content solely to the extent reasonably necessary to operate, provide, and improve the Service — for example, to display your profile to other members, generate blurred preview images for the free tier, run automated moderation, and investigate reports. The license ends when Your Content is deleted from our active systems, subject to backups and legal-hold retention described in our Privacy Policy.

You represent that you have all the rights needed to grant this license and that Your Content does not infringe anyone's rights or violate any law.

We do not sell Your Content to data brokers. We do not use Your Content to train general-purpose third-party AI models. We may run in-house automated systems (for example, content filters, spam detection, or image moderation) on Your Content as part of running the Service.

You can remove most of Your Content at any time by editing your profile or deleting the relevant item. Some content — for example, messages you have sent to other members — cannot be unilaterally unsent from their inbox for the obvious reason that we don't control their device; deletion on our side hides the content from the Service going forward.

You agree that you will not:

• Harass, intimidate, stalk, or threaten another member, whether on or off the Service.
• Post, send, or request sexual content involving minors, or any content depicting non-consensual acts.
• Solicit money, gifts, or financial assistance from other members.
• Run escort, sugar-dating, or commercial sex advertising, or any other paid-companionship arrangement.
• Pretend to be someone else, use someone else's photos without their consent, or misrepresent material facts about yourself.
• Advertise, promote, recruit for, or otherwise market any product, service, business, or political campaign, including multi-level-marketing offers.
• Scrape, crawl, or use automated means to access the Service or extract data from it, except through APIs we formally publish.
• Attempt to probe, disable, or bypass any security or rate-limit feature of the Service.
• Upload or transmit viruses, malware, or code designed to harm the Service or its users.
• Post content that is illegal under applicable law, including defamation, threats of violence, incitement to violence, or content that infringes intellectual-property rights.
• Use the Service in a way that violates sanctions or export laws.
• Resell, sublicense, or provide the Service to a third party.

The list above is not exhaustive. If a behavior you're considering would embarrass HonmeiDate if it appeared in a news article, assume it is not acceptable.

HonmeiDate helps people meet, but it cannot make another person trustworthy. We do not perform comprehensive background checks on members. Any identity-verification badge we display reflects a limited, best-effort process — it is a signal, not a guarantee.

Please take the same precautions online that a thoughtful person would take offline:

• Don't share sensitive financial information (bank details, passwords, one-time codes) with anyone you met on the Service.
• Be cautious of stories that pressure you to send money, invest in cryptocurrency opportunities, or act urgently.
• If you decide to meet in person, meet in a public place, tell a friend, and arrange your own transportation.
• If something feels wrong, trust that instinct. Block, report, and — if a crime may be involved — contact local authorities.

We publish anti-doxxing, anti-grooming, and anti-scam guidance on the Chat Policies page. Read it.

We run automated and human moderation to enforce these Terms and our community policies. Moderation may include — without limitation — filtering messages, hiding or removing content, rate-limiting, muting, banning from specific rooms, suspending accounts, or permanently closing accounts.

If another member is violating these Terms, please report them using the in-app report button or via our support channels. We will review every report, though we do not promise a specific response time or outcome for any individual case.

When we act on a report we may review relevant messages, including private messages, solely for the purpose of investigating the report and protecting the community. We aim to minimize the scope of any such review.

Decisions to suspend or terminate an account are made in our reasonable discretion. We may preserve banned-account data where we reasonably believe it is needed for safety, fraud prevention, legal compliance, or future enforcement.

Our Privacy Policy explains what personal data we collect, how we use it, how long we keep it, and the rights you have over it. That policy forms part of these Terms by reference. You should read it before using the Service.

We do not sell, rent, or trade personal data to third parties for marketing.

We handle personal data in line with applicable law, including the Act on the Protection of Personal Information (APPI) of Japan and any other law that applies to you because of where you live. You can exercise access, correction, and deletion rights described in the Privacy Policy by contacting support.

The HonmeiDate name, the MensuraMedia name, the HD logo, the visual design, the site code, the copy we write, and every feature we build are owned by MensuraMedia or its licensors and are protected by copyright, trademark, and other intellectual-property laws.

We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for its intended purpose — to meet people. That license does not include any right to copy, modify, translate, reverse-engineer, or create derivative works of the Service, or to use the HonmeiDate brand in your own products or content, except as required for you to use the Service normally or as permitted by non-waivable law.

Any feedback, ideas, or suggestions you send us about the Service may be used by us without compensation or attribution to you.

The Service may link to, embed, or rely on services operated by third parties — for example, payment processors, identity verification providers, or email senders. When you use a third-party service through HonmeiDate, that provider's own terms and privacy policy apply to your use of its service.

We do not control and are not responsible for the content, accuracy, availability, or practices of any third-party service. Including a link or integration is not an endorsement.

You can delete your account at any time from the Settings menu. Deletion removes your profile from public view and starts the deletion process described in our Privacy Policy. Some information may be retained for limited purposes such as legal compliance, fraud prevention, or safety.

We may suspend or terminate your account — with or without prior notice — if we reasonably believe that you have breached these Terms, engaged in fraudulent or harmful conduct, or created a meaningful safety risk to other members. Where practical and appropriate, we'll tell you what rule you broke and give you a chance to respond before closing the account.

Sections of these Terms that by their nature should survive termination will survive — including the content license you granted, the IP and disclaimer sections, limitation of liability, indemnity, and dispute-resolution terms.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, MensuraMedia disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, free of viruses or other harmful components, or will meet your expectations; that it will produce any particular result, including a date, a relationship, or a marriage; or that any specific member or match will contact you or turn out to be who they said they were.

Some jurisdictions do not allow certain disclaimers. Where that is the case, those specific disclaimers do not apply to you, and our liability is limited to the minimum the applicable law allows.

To the fullest extent permitted by law, MensuraMedia, its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising out of or relating to your use of the Service — even if we were advised of the possibility of such damages.

Our total cumulative liability to you for any and all claims arising from or related to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve months immediately before the event that gave rise to the claim, or (b) the equivalent of 100 Japanese yen.

These limits apply regardless of the legal theory (contract, tort, statute, or otherwise) on which the claim is based. Some jurisdictions do not allow limits of this kind. Where that is the case, this section applies to the maximum extent the law permits.

You agree to defend, indemnify, and hold harmless MensuraMedia, its affiliates, and their officers, directors, employees, and agents from and against any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of:

• your breach of these Terms;
• Your Content or your use of the Service;
• your interaction with another member, on or off the Service;
• your violation of any law or of any third party's rights.

We will notify you of any such claim and may, at our option, take control of the defense. You may not settle any claim in a way that affects our rights or obligations without our prior written consent.

Try to talk it out first.

If you have a concern or a claim, contact us before taking formal action. Most issues we've seen can be worked out directly — and it is better for both sides than a proceeding. Please describe the issue, what outcome you would like, and the contact information we can reach you at.

Informal resolution period.

If we can't reach an agreement within sixty (60) days of you contacting us in good faith, either side can move to formal proceedings under Section 17 (Governing law and venue).

Time limit.

Unless applicable law says otherwise, any claim you bring against us relating to the Service must be filed within one (1) year after the claim arose. After that, the claim is permanently barred.

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of Japan, without regard to its conflict-of-laws rules. Any claim that cannot be resolved under Section 16 (Dispute resolution) shall be brought exclusively in a competent court of Japan, and you submit to the personal jurisdiction of those courts.

Nothing in this section restricts consumer rights that apply to you under the law of the country where you live and that cannot be waived by contract.

We may revise these Terms from time to time. When we make a material change, we'll update the effective date at the top and give you reasonable advance notice — typically by email and a prominent in-app notice.

If you keep using the Service after a change takes effect, you accept the revised Terms. If you don't accept them, stop using the Service and, if you like, delete your account.

Unless law requires a specific method, we may send you notices by email to the address on your account, by in-app notification, or by posting on the Service. Notices are effective when sent or posted, whichever comes first.

You consent to receive communications from us in electronic form. Electronic communications satisfy any legal requirement that such communications be in writing.

You should keep your email address up to date; notices we send to a stale address are nonetheless effective if we had no reason to know it was out of service.

Entire agreement.

These Terms, together with the Privacy Policy and any policies referenced here, form the entire agreement between you and MensuraMedia regarding the Service. They supersede any prior agreement on the same subject.

Severability.

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed only to the extent needed to make it valid, and the remainder of the Terms will continue in full force.

No waiver.

Our failure to enforce any right or provision is not a waiver of that right or provision. A waiver is effective only when we give it in writing.

Assignment.

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.

Force majeure.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control — for example, natural disasters, government actions, labor disputes, internet-infrastructure outages, or cyber-attacks.

Headings.

Section headings are for convenience and do not affect interpretation of the Terms.

No third-party beneficiaries.

These Terms are between you and MensuraMedia. No other person has rights to enforce them.
